The information submitted by registrants is reviewed by the Treasury Department to ensure there are no outstanding law enforcement concerns. Registration is a prerequisite to export licensing approval.
Registration, which does not confer any export rights or privileges, is a precondition for the issuance of any license or other approval for export. Registration process with DDTC consists of submitting a complete package consists of a DS-2032, Transmittal Letter, Legal Documentation and other attachments as needed (pursuant to ITAR §122.3), submitted at least 30 days prior to expiration date. Registration must be current to apply for export licenses or other approvals, or to use export exemptions. A current registration also means notifying DDTC of any changes to transmittal letters or material change in the information contained in the Registration Statement (ITAR §122.4).
Department of State approval of a license application is required prior to the export of defense articles or defense services. In submitting license applications, companies must certify eligibility to export and an understanding of the laws governing such exports. Moreover, in carrying out the physical act of exporting, they must meet certain conditions in terms of documentation (electronic reporting of export information using the Automated Export System, “AES”) and handling (particularly of classified material).
