He married HANNAH MCNEAL 1788 in Pennsylvania, daughter of ROBERT MCNEAL and JEAN BAKER. She was born August 17, 1770 in Lancaster County, Pennsylvania, and died July 11, 1811 in Jamestown, New York.

Family tradition says that original burial was elsewhere; later removed to the Hamer Cemetery. Frank V. Hamer confirmed this tradition. He and his Uncle J. Frank Hamer, Bedford Undertaker, moved the skeleton and stone of Thomas Hamer, and the skeletons and stones of Henry and Elizabeth Fitzpatrick, in March of 1937 from the Jolly Cemetery in Bono Township to the Hamer Cemetery in Marion Township. Documentation found in the oral history records of the Mitchell City Library.

HAMMER THOMAS 2 REG'T (DOBBIN'S), NEW YORK MILITIA. PRIVATE PRIVATE 90 602

There is a warrant #22714 to a Thomas Hamer for services in the War of 1812, a private in Grosvenor Company of the 26th Regiment of Infantry, that grants him bounty land in Arkansas Territory, dated Sept. 8, 1821.

One family source says Thomas Hamer moved to Ohio and, on July 9, 1819, came to Indiana with his son, Joseph, and daughter, Lettie. This source also says that Lettie Hamer married a Mr Bausley and moved to Ottawa, Kansas. Another source says the brothers, James, Joseph, Lettie, and their father, Thomas, came to Indiana in 1828 or 1829 from Ohio, and Lettie married a Mr. Bausley and moved to Ottawa, Kansas. We know that Lettie married John Bosley in New York and moved to Ohio. After John's death she went to Ottawa, Kansas, to join several of her children, Harriet, Thomas Jefferson, and Almira. She returned to Ohio in 1893 and died at the home of her daughter, Laura.

On August 25, 1826, a notice was served that Thomas Hamer had voted in an election for State Representative in Bono Township, Lawrence County, Indiana. It was further stated that he was not a legal resident of Lawrence County, Indiana. So, the election of Louis Roberts was being challenged by John Brown.

The will of Robert McNeal in 1818 mentions the children of Thomas Hamer & Hannah McNeal:

(That is to say) First I give and bequeath to my Eldest Mary Blain the following Sum that is to say the Value of twenty Acres of My farm in the above mentioned Town County and State together with following articles Namely One feather bead bedstead calico Bedspread One Sheet and pillow One Cloak one large Bible and umbrella one pair linning stockings One white Strait bodice Coat Vest and hat one puter dish. One source for the Hamer-McNeal family is the so-called McNeall Synopsis, composed about 1934. It consists in an outline of names with some annotation.

Family tradition says that Hannah McNeal Hamer died in Jamestown, New York, in 1811. A history of the village of Jamestown says that no deaths occured from the founding of the village in 1810 until 1815. Perhaps the Hamers were in the countryside around Jamestown.

"William Hamer was born in Geneseo, New York, in 1791. In 1815 he married Kezia Cleveland, who died Sept. 19, 1856. He came to Ohio in 1826 and began keeping tavern at the [Hamers} Corners. Soon after that time he laid out the first town lots in Centreville, now Clyde. He married for his second wife, Mrs. Priscilla Blanchard, who is yet living."

Death of An Old Citizen. William Hamer, one of the oldest inhabitants of Sandusky county, died at his residence in Clyde (Ohio), Wednesday, Dec 26th, at the age of 75 years. Mr. Hamer was one of the first settlers here, and the little town from which Clyde came was named after him, as Hamer's Corners. He was very widely known, perhaps more so than any citizen of Clyde. In June last, Mr. Hamer's only daughter died of consumption. From that day the old gentleman went down.

Priscilla S. Hamer. On Wednesday of this week undertaker George F. Supner received a telegram from Reading, Michigan announcing the death of Mrs. Priscilla S. Hamer and requesting him to meet the remains at the Lake Shore Depot here at 6:15 last evening. At that time the body arrived here, accompanied by her son in law, Orson Grover, and his son Charles. The body was taken to Supner's undertaking rooms where it remained until nine o'clock this morning, when it was taken to Bakertown cemetery for interment, accompanied by friends of the deceased, there being no funeral services here except brief services at the grave by Rev. J.M. Davies, of the Baptist church. Mrs. Hamer was one of the earliest residents of Clyde, and it was from her second husband, William Hamer, that the early hamlet of Hamer's Corners, now Clyde, received its name. The family lived for many years in the house now owned and occupied by C.L.Dirlam, where her husband died many years ago. Mrs. Hamer was born in Massachusetts and was there married to Cephas Blanchard. They came to this place about 1840, and upon the death of Mr. Blanchard whe was married about 1862 to Mr Hamer. She remained a resident of Clyde until July 1890, since which time she has made her home with her son in law, Orson Grover, at Reading, Michigan. She died there on Wednesday, March 20th at the age of 83 years, 4 months and 18 days. Deceased was well known among older residents of Clyde as a most estimable lady. She leaves no near relatives here or elsewhere. Orson Grover, who accompanied the remains here, is a brother of Truman Grover, west of town.

Hamer. At the residence of her son in law, Orson Grover, Reading, Michigan, Wednesday, March 20, 1895, Priscilla S. Hamer, aged 83 years, 4 months and 18 days. The body was brought to Clyde and taken to the Bakertown cemetery for interment where a brief service was held by Rev. J.M. Davis, of the Baptist Church. The Clyde Interprise says: " Mrs. Hamer was born in Massachusetts and was there married to Cephas Blanchard. They came to this place about 1840, and upon the death of Mr. Blanchard whe was married about 1862 to Mr Hamer. She remained a resident of Clyde until July 1890, since which time she has made her home with her son in law, Orson Grover, at Reading, Michigan. Notes for NANCY HAMER:

Nancy Hamer seems to have married Lemuel Jennings in 1816, according to the DAR record of Louise R. Riley, then Roswell Crowfoot in 1822, according to Clarice Evans DeWreede.

Family histories report her to be the village schoolteacher at Spring Mill after the death of her second husband, Roswell Crowfoot. Her name is sometimes spelled Nancy Crofoot. She came between 1830 and 1840, since Charles was born in 1830, and Euphemia was married in Indiana in 1833. She was called "Aunt Nancy". She was teacher to Almira Hamer Lucas, who was left handed. Aunt Nancy tried to make Almira right handed. Almira remembered this even in her old age. Family histories report Nancy as moving to Louisville, Kentucky, and remarrying. They also report her death as 1890.

According to Family Tradition, Hugh traveled with brother, Thomas L., to Indiana in 1816 for John Hamersley of New York, who later ran a mill in Bono Twp, Lawrence Co, Indiana. Hugh and Thomas L. returned to Indiana by 1820 and lived in the area of Clifty Falls, then worked at Spring Mill until they bought it. Hugh was active in politics. Postmaster in 1829; County Commissioner in 1830's; State representative in 1839 and 1840; State Senator in 1844.

Biographical Directory of the Indiana General Assembly (1980) has the following:

In the Fall of 1835 Hugh Hamer made a trip East to see his family. He stopped in Georgetown, Ohio, to see his cousin, Thomas L. Hamer, son of William Hamer. He may have visited Pennsylvania and New York as well as Ohio. He wrote a letter to Thomas L. Hamer, his cousin, on returning to Indiana. He reported that his brothers were well and the government roads were terrible. His relatives had inquired about Thomas L. Hamer from Hugh when he visited them. He was sorry he was not able to return by way of Georgetown. He was also sorry that his poor grammar had not allowed him to write more often. He bewailed his Hamer pride and hoped Thomas L. had conquered this family trait. This letter is in a collection of Thomas L. Hamer correspondence in the Huntington Library in California.

In the name of the Benevolent Father of all. I, Hugh Hamer, of Lawrence County and state of Indiana, being in feeble health, but of sound and disposing mind and memory, do make and publish this my last will and testament, that is to say:

Item 1 - I give and devise to my beloved wife Elizabeth Hamer all the real and personal estate of which I may be possessed at my death to use and control, sell and dispose of, without an accounting to court of her doings therein.

Item 2 - I make and appoint my beloved wife the said Elizabeth Hamer executrix of this my last will and testament. In witness hereof I have hereunto set my hand and seal this 24th day of February, 1872. Signed: Hugh Hamer.

The Probate papers state that Thomas L. Hamer died August 9, 1856. Hugh Hamer began the probate August 28, 1856. He was assisted by Helmsley Wood.

The court met pursuant to adjournment on Wednesday morning, July 7, 1858 at 8 o'clock. Estate of Thomas L. Hamer. Comes now Hannah Hamer, and proves that she is the widow of the deceased and that Hugh Hamer, Thomas L. Hamer, Harrison Hamer, Angeline McNabb, wife of Humphry McNabb, and Minerva Wood a minor heir of Mahala Wood, deceased, are the heirs of the deceased and that said Hugh Hamer and Thomas L. Hamer have released all their interest in said estate, having been advanced their full portion thereof, by the decedent, in his lifetime, and that the said Minerva has received by way of advancement the sum of $263.50. Thereupon it is ordered that the residue of said estate remaining at final settlement be distributed as follows towit: to said Hannah the sum of $367.16 2/3; to said Angeline McNabb the sume of $367.16 2/3; to said Harrison Hamer $367.16 2/3; and to said Minerva Wood $103.66. (Acknowledgement of receipt from each then follows.)

Daisy Evans Padgett made a good argument for the spelling "Lettie", and this is found in the LDS records. Lettecia is the form which she used in signing her last will and testament.

According to one Hamer family tradition, Lettie Hamer came to Indiana about 1828/1829 with her brothers James and Joseph, and her father, Thomas Hamer Jr. (b1766). Another tradition has them coming from Ohio rather than New York. She married a Bausley/Bosley and later moved to Ottawa, Kansas, according to tradition, as well. We know that Lettie married John Bosley in New York and came to Ohio about 1830. After John's death she went to Ottawa Kansas to be with her children who had moved West. She returned to Ohio and died at the home of her daughter, Laura. Her granddaughter, Clara Harrington Blinn, was kidnapped in an Indian raid in Colorado and was killed in an Indian battle in Oklahoma.

January 1st, A. D., 1834. This day I felt some of the effects of the fever and ague.

January 2nd. The Church met according to previous appointment. Four high priests and three elders were present. After the meeting was opened we explained the reasons why E. Landen was cut off. The following persons requested their names to be taken from the Church record of names, viz.: Lester More, Daniel More, Letitia Bosby, Aaron Clark, Rodman Clark, Polly Kelly. The Church therefore were called upon to raise their hands against them and they were cutoff.

January 3rd. Attended a meeting at the Brick Schoolhouse in Avon. Brother Amasa preached.

January 5th. Being the Sabbath, preached at the schoolhouse near Brother Orton's upon the vision.

January 6th. Held a church meeting and the following persons were cut for disbelieving the work and bad conduct: Hannah More, Albert More, Masy More, John Bosely, Ruby Landen, John Heth.

January 9th. Attended a prayer meeting at Brother Bosley's.

And now on this 30th day of December, a.d. 1893, comes Samuel Walgamot, who being first duly sworn upon his oath saith: My name is Samuel Walgamot, my residence is Marion, Kansas, my age is 70 years; I was acquainted with Lettecia Bosley, a resident of Franklin County, Kansas, several years in her lifetime; I was present at Ottawa, Kansas on the 31st of January, a.d. 1881 and saw the said Lettecia Bosley sign the foregoing instrument of writing, purporting to be the last will and testament of the said Lettecia Bosley and heard her publish and declare the same to be her last will and testament, and at her request and in her presence and in the presence of S.J. Stoughton & Tyler Baldwin I signed said instrument as a subscribing witness thereto. And the said S.J. Stoughton & Tyler Baldwin at the request of said Lettecia Bosley and in her presence and in my presence, signed said instrument as subscribing witnesses thereto. At the time of signing said instrument, said Lettecia Bosley WAS ABOUT 77 YEARS of age; she was of sound mind and memory and was not under any restraint or undue influence whatever. In the name of the benevolent Father of all.

I Lettecia Bosley of the city of Ottawa, in the county of Franklin & state of Kansas, and being of lawful age and of sound mind and memory, declare this to be my last will and testament.

FIRST, I give devise & bequeath all my personal property of what kind or nature soever it may be, of which I may be the owner & possessor at the time of my decease, to my four children, viz: Harriet E. Herrington, Thomas J. Bosley, Laura B. Keyser & Almyra Mottram, to be by them received in equal proportions & value and to receive share and share alike.

SECOND, I give, grant & devise to my said four children ... and to their heirs & assigns, all and singular the real estate of any & all kinds and description whatsoever of which I may be the owner or seized or both, at the time of my decease ...

THIRD, Any or all interest in or to any real estate of any kind or nature or description equitable or legal or otherwise, which I may have anywhere in any place or locality ... I give grant & devise to the said Harriet E. Herrington, Thomas J. Bosley, Laura B. Keyser, and Almyra Mottram ...

FOURTH, Should Almyra Mottram die without issue of her body prior to my decease ... all ... shall go in equal parts ... to my other three children ...

I HEREBY NOMINATE & appoint Thomas J. Bosley Executor of this my last will and testament.

IN TESTIMONY whereof, I, Lettecia Bosley have to this my last will and testament consisting of two pages of paper subscribed my name this 31st Day of January, 1881, at the city of Ottawa, in the county of Franklin, and state of Kansas in presence of S.J Stoughton and Tyler F. Herrington, daughter, 68 yrs old, Osage County, Kansas; T.J. Bosley, son, 66 yrs old, Centropolis, Franklin County, Kansas; Laura B. Keyser, daughter, 62 yrs old, Maumee City, Ohio; Myra Mottram, daughter, 54 yrs old, Ottawa, Franklin County, Kansas. Know all Men by these Presents, That Leticia Bosley Administratrix for the estate of John Bosley and George Knagg & Jefferson Bosley sureties, are joined and firmly bound to the State of Ohio in the penal sum of Three hundred dollars, to the payment of which we firmly bind ourselves, our heirs, executors and administrators firmly by these presents. Signed with our hands and sealed with our seals this Twelfth day of March A.D. 1852.

The condition of the above bond is such, that if the said administrator shall

First, To make and return into court, on oath, within three months, a true inventory of all the moneys, goods, chattels, rights and credits of the deceased, which have or shall come to his possession or knowledge; and also, if required by the court, an inventory of the real estate of the deceased:

Secondly, To administer, according to the law, all the moneys, goods, chattels, rights and credits of demand, and the proceeds of all his real estate. That may be sold for the payment of his debts, which shall, at any time, come to the possession of the administrator, or to the possession of any other person for him:

August 16, 1998. Blue Tour highlights northern Lawrence County. Checkpoint 15 is the junction with Ind. 58 in Springville. Turn left and travel four miles to Avoca. Checkpoint 16 is the Avoca Fish Hatchery. The hatchery grounds are open to the public. The old white house on the grounds serves as the property manager's home and is not open to the public. The house was once a stage coach stop and was the home of Joseph Hamer, brother of the men who operated Hamer's Mill at Spring Mill State Park near Mitchell. This Hamer also operated a mill on the hatchery grounds. The mill is no longer standing. (Bedford Times-Mail)

Avoca Landmark (Picture of residence at the Avoca Fish Hatchery by Claude Parsons). History of Avoca Dates Back to 1818; House at State Fish Hatchery Is 133 Years Old, By Claude Parsons. One of the oldest buildings in Lawrence County can be found in the town of Avoca. The building, which is reported to be 133 years old, is now the residence of the superintendent of the Avoca Fish Hatchery. In the early days, the building was an inn and travelers felt right at home there. It was built in 1823 by the Hamer Brothers, of North Carolina, who were the first settlers of the town back in 1818. One north upstairs room of the building was opened up as a grocery store in 1828. Avoca, with a present population of about 300, is located six miles northwest of Bedford in Marshall township. The first mill in the township, as well as being one of the earliest in the county, was build at Avoca about 1819 by a man named Fitzpatrick, and later sold to the Hamer Brothers. It was operated by a turbine waterwheel, and had three sets of buhrs -- one for wheat, one for corn, and one for chop feed. In 1884 the mill was valued at $2500... (Bedford Times-Mail, 1956) (The Hamer Brothers were not from North Carolina. They were from New York. The wives of the younger brothers were from North Carolina.)

Notes from Family Reunions. Avoca Mill Site. The mill at Avoca, which was built in 1819, burned down in the 1860's and was rebuilt. The mill was operated by turbine waterwheels. Water to run the mill came from a large underground spring which surfaces from a cave near the mill site. The mill had three sets of buhrs, one for wheat, one for corn, and one for chop feed. Hugh Hamer, Thomas L. Hamer, and Edward Fitzpatrick, their brother in law, built a house in 1823 for the residences of the mill owner. This building still stands, and is one of the oldest buildings in Lawrence County. The furnishings from the home were brought in by ox cart from Louisville, Kentucky. Although the home was built as a residence, over the years it has served as an inn, a post office, a general store, and a grocery store. It now serves as a residence for the superintendent of the Avoca Fish Hatchery, which bought the property in 1924. Edward Fitzpatrick owned and operated the mill from 1819 until he sold it to Absolam Hart. James Hamer and Joseph Hamer came to Indiana about 1828 or 29. They married sisters Sophia (1-5-1832) and Evaline Wood (7-17-1834), and on July 24, 1834, these brothers bought the mill and 200 acres of land for $800, from Absolam Hart (deed recorded on 6-9-1835). With a bright future and four little children, Joseph decided to buy the entire ownership of the mill and make a home for his family. On December 10, 1838, he bought out James for the sum total of $2,100. (Mortgage recorded on said date and deed recorded on December 11, 1839.) Sadness befell Joseph when his wife died on August 10, 1841, only a year and a half after buying. Because of this unforeseen circumstance, Joseph sold back the mill, house, and land to James Hamer. James acknowledges mortgage and signed it as fully satisfied on February 22, 1842. Joseph remarried on November 21, 1842, to Martha Jane Maddox and left Avoca to move to the Spring Mill area. By 1884 the mill was valued at $2,500. But after many years of disuse, it was bought and moved to Owensburg, Indiana, to be used as a private home. The place where this mill stood at Avoca can still be seen today.

In the matter of Pension Claim no. 345.794 of Joseph Hamer, as father of Hugh Hamer, Co. "F:, 15th Regiment, Indiana Volunteers. Personally came before me a Justice of the Peace in and for aforesaid county and state, Joseph Hamer, aged seventy nine years, county of Orange, State of Indiana, well known to me to be reputable and entitled to credit, and who, being duly sworn, declared in relation to aforesaid case as follows: that he resided in Lawrence County, Indiana, and that his post office address was Mitchell, Indiana, in the year 1863, and remained his residence until the year 1871; that he then removed to Daviess County, Indiana, and his post office address was Washington, Daviess County, Indiana; and that was his post office address until about the year 1880; that he then broke up housekeeping and has since been living with his son in law, in Dubois County, Indiana, and that Hillham has been his postoffice address ever since to the present time; that the names and ages of his family in the year 1863, consisted of the following named to wit: his self, Joseph Hamer born Sept 5, 1808; his wife, Martha J. Hamer, born July 14, 1823; ; Hugh Hamer, born September 15, 1835; Elizabeth Hamer, born March 6th, 1838; George W. Hamer, born Feb 22nd, 1840; Hannah Hamer, born born January 16th, 1843; Evalina Hamer, born November 6, 1846; Josephine, born June 14th, 1849; James M. Hamer, born October 25th, 1854; Arabell Hamer, born Dec 7th, 1858; that these were the names and members of his family in 1863; he also states that his son, Hugh Hamer, was never married; that at the time his son Hugh Hamer died he was depending on him to help keep up the family; that while said son was in the military service he sent money home to him to the amount of three hundred dollars; that before his son entered the military service he helped him work and provide for the family, and after he enlisted in the military service his son Hugh Hamer sent him three hundred dollars; that his son, Hugh, died on the 6th day of December 1863; That in the year 1863 he was the owner of a small piece of land near Mitchell, Indiana; that he paid for said land the sum of six hundred dollars; that he went to work and improved said land by building a house, and improving and repairing said land; that in a few years after he had purchased said land he became largely in debt, and was compelled to sell the same to pay his creditors, and when he had sold said land in the year 1871 he only had a few dollars left after paying his debts; siad claimant further states that he has been twice married; that his first wife was the mother of Hugh Hamer; that he has had to depend greatly on his children for his support for the last 25 years. Declaration for An Original Pension of a Father or Mother. State of Indiana, County of Lawrence ss.

On this 11th day of October, A.D. one thousand eight hundred and eighty six personally appeared before me, Thomas V. Thornton, Clerk of the Circuit Court, a Court of Record within and for the county and State aforesaid, Joseph Hamer, aged 78 years, who , being duly sworn according to law, makes the following declaration in order to obtain the Pension provided by Acts of Congress granting Pensions to dependent relatives: That he is the Father of Hugh Hamer who enlisted under the name of Hugh Hamer at Bedford, Indiana, on the 14th day of June, A.D. 1861, in Co. "F", 15th Indiana Volunteer Infantry in the War of 1861, who received a gunshot wound in the ankle joint of his right foot, causing amputation of right leg, below the knee, and afterward a second amputation of thigh, which resulted in the death of said soldier on December 6, 1863, at or near Chattanouga, Tennessee. He bore at the time of his death the rank of private, in Co. "F", 15th Indiana Volunteers. That said son, Hugh Hamer, left neither widow nor child under sixteen years of age surviving; that said declarant was married to the Mother of said son at Lawrence County, Indiana, on the 17th day of July, A.D. 1834, by Squire Porter, that he was dependent upon said son for support; that the Mother of said son died at Lawrence County, Indiana, on the 10th day of August , A.D. 1841; that there were surviving at date of said soldier's death his brothers and sisters, who were under sixteen years of age, as follows (children of second wife): Josephine Hamer, born June 14, 1849; James M. Hamer, born October 26, 1854; Arabell Hamer, born Dec 7, 1858; that he has not heretofore received or applied for Pension; that he has not aided or abetted the Rebellion; and that Declarant hereby appoints, with full power of substitution and revocation, Anthony W. Jones of Mitchell, Indiana, true and lawful attorney to prosecute his claim; that his residence is Warren Street, Mitchell, Indiana and his Post Office address is Mitchell, Indiana. General Affidavit of Elijah Evans in Pension Claim of Joseph Hamer. State of Ind, Cty of Lawrence ss.

In the matter of pension claim no. 345.794 of Joseph Hamer as father of Hugh Hamer, Co "F" 15th Regiment Indiana Vols, personally came before me a Justice of the Peace in and for said county and State, Elijah Evans, aged 43 years, a citizen of the town of Mitchell, county of Lawrence and state of Indiana well known to me to be reputable and entitled to credit and who being duly sworn declared in relation to aforesaid case as follows: that he is personally acquainted with claimant, has know him for 30 years last past; that he has seen the family Bible of the claimant giving the dates of the births and deaths of Hugh Hamer and Evalina Hamer as follows: Hugh Hamer was born on the 15th day of September, 1835; and Evalina Hamer died on the 1pth day of August, 1841. That he has no interest in this calimant for a pension; his post office address is Mitchell, lawrence County, Indiana. Signed: Elijah Evans. In the matter of Pension Claim no. 345.794 of Joseph Hamer, father of Hugh Hamer, Company "F" 15th Regiment Indiana Volunteers. Personally came before me a Justice of the Peace in and for aforesaid county and state, Wesley Weaver, aged fifty years, citizen of the county of Orange, State of Indiana, well known to me to be reputable and entitled to credit, and who, being duly sworn, declared in relation to aforesaid case as follows: That he is well and personaly acquainted with claimant, Joseph Hamer; That he has known him for forty years last past; That he has lived with him in his family for the last seven years past; That he has had to support said applicant all the time he has been with him; That he is quite feeble and not able to help himself except to walk around and not able to do any work; he further states that said applicant has had to depend on his children and friends for the last twenty five years; That he has had no income, excpt what little work he could do himself; and for the last several years he has not been able to perform scarcely any manual labor at all. In the matter of Pension Claim no 345.794 of Joseph Hamer as father of Hugh Hamer Co. "F: 15th Regt Ind Vols. Personally appeared before me a Justice of the Peace in and for aforesaid county and state, Amzi L. Munson, aged 59 years, citizen of the town of Mitchell, county of Lawrence, State of Indiana, well known to me to be reputable and entitled to credit, and who, being duly sworn, declared in relation to aforesaid case as follows: That he is wll and personally acquainted with Joseph Hamer and has known him for 45 years; that he remembers well that said Hamer had a serious spell of typhoid fever in 1853; and knows that said Hamer has never been stout since; that said Hamer has often complained when he would be with him of his back hurting him. Affiant further states that he knows of said Hugh Hamer, son of Joseph Hamer working for his father by day's work, before he entered the military service; that said claimant was never himself after his sickness with fever; that as to his income he had none except by day's work; he further declared that he has no interest in said case and is not concerned in its prosecution and is not related to said aplicant.
