History of Hamilton County Ohio. CHAPTER XX CIVIL LIST OF HAMILTON COUNTY. In April, 1801, when the public lands west of the Great Miami were first offered for sale at Cincinnati, a notable purchase was made in the northwest part of what is now this township. Jeremiah Britterfield, an enterprising young Massachusetts man who had come to Cincinnati shortly before as a prospector, and had assisted Colonel Ludlow to run the boundary line between the territory of the United States and that of the Indian tribes, as prescribed by the Greenville treaty, formed a company with Knoles and Alvin Shaw, their father, Esquire Shaw, Asa Harvey, and Noah Willey, to make investments in the lands. They bought at the first sales two full sections and as many large fractional sections, extending from near the mouth of Indian creek, in what is now Butler county, about three miles down the Great Miami into this township and county. The tract comprises about two thousand acres, nearly all bottom land, perfectly level, and exceedingly fertile. In order to secure it the company bid ten cents per acre above the minimum price, thus getting for two dollars and a dime an acre a tract probably now worth not less than two hundred thousand dollars. The six joint owners then divided the land, under a survey made by EMANUEL VANTREES and according to the amounts they had respectively paid, each having a front on the river and his piece stretching back to the west line of the tract. Mr. Butterfield thus obtained eight hundred acres, partly in Buttler and partly in Hamilton county. His own residence he fixed at a point near where Venice has since been founded. He handsomely improved his place, being the first in that region to plant an orchard, became an influential and wealthy citizen, and died at a good old age June 27, 1853. His sons Sherebiah, John, and Jeremiah, have since lived prosperously on parts of the ancestral estate, in Crosby township. The first named was during many years a justice of the peace for the township.

Col. John Van Trees, the father of Mrs. (Hiram) Hyatt, was born on September 4, 1804, on the Little Miami river, near Cincinnati, Ohio, a son of Emanuel and Julia (Storms) Van Trees. Emanuel Van Trees was a native of Pennsylvania, and his father was a native of Heidelburg, Germany. Emanuel Van Trees came to Daviess County in 1819 and helped lay out the town of Washington. He had come west, however, about nine years previously. He died in a log house that stood on what is now the corner of East Sixth and Main streets, in the county seat. He was the first clerk of the court in Daviess County, and was succeeded in that office by his son, Col. John Van Trees, at the time of his death.

The clerk of the county board also acted as clerk of the circuit court. Emanuel Van Trees first performed the duties of this office and was succeeded by John Van Trees about the year 1824.

Daviess County Indiana History, by L. Rex Myers. 1988. p324. VanTrees. Emanuel VanTrees was born in Pennsylvania 1768. His father was a native of Heidelburg, Germany. Emanuel married Juliana Starms 1790 and moved to the Washington, Ind. area, via the Ohio River with the Robert Bennefield and John VanCleve families. They settled in the French location #304 east of Vincennes. This location was listed on the original plat, dated 1813, as Liverpool. The name was changed to Washington in 1816 when Indiana became a state. This plat was recently given to the Daviess County Historical Society. Samuel Wilkins and Emanuel VanTrees donated land where Washington, In. now stands, thus the VanTrees Street which was named after him. John Merriam Van Trees, the son of Emanuel, was appointed colonel in the 24th Regiment Indiana Militia. Colonel John VanTrees married Laura G. Prentiss, May 27, 1830. They had eleven children. John built the VanTrees home at 600 E. Main St., Washington Ind. In this city block were several homes built by persons related to the VanTrees family. Names such as Winston, Boyd, Scudder, and Hyatt. Warren VanTrees built on the northeast corner of 6th and VanTrees Streets. It has been told and handed down through the family that Abraham Lincoln, then an unknown travelling attorney, stopped in Washington and called on Colonel John VanTrees for information regarding the area. Nothing has appeared in writing regarding this, so no way to say if such is true. Direct descendents of Emanuel VanTrees known to be living are Warren VanTrees, Jr., his son, James Barrett, and his three sons, Craig, Neil, and John; and warren's daughter, Susan VanTrees, all now living in Rushville, Ind. Colonel John had a son, Thomas. Thomas had a son, Warren. Warren operated a drug store several years in Washington, known as the VanTrees Drug Store. He was at one time City Clerk of Washington, Ind. --- Submitted by Warren Van Trees. 1987.

Col. John Van Trees, the father of Mrs. (Hiram) Hyatt, was born on September 4, 1804, on the Little Miami river, near Cincinnati, Ohio, a son of Emanuel and Julia (Storms) Van Trees. Emanuel Van Trees was a native of Pennsylvania, and his father was a native of Heidelburg, Germany. Emanuel Van Trees came to Daviess County in 1819 and helped lay out the town of Washington. He had come West, however, about nine years previously. He died in a log house that stood on what is now the corner of East Sixth and Main streets, in the county seat. He was the first clerk of the court in Daviess county, and was succeeded in that ofice by his son, Col. John Van Trees, at the time of his death. Col. John Van Trees was educated in the pioneer schools of Daviess county, but was almost wholly self-educated. He stood high in the educational affairs of Daviess county in his day and generation. He was a thorough master of the German language, as this language was spoken in his home. After retiring from the office of county clerk he became a merchant, and for many years was engaged in the mercantile business. He died on January 18, 1895, at the advanced age of ninety years. Col. John Van Trees erected a fine house in the colonial style in the place of the log house which his father had built, and lived there the rest of his life, this house still being owned by the family. Early in life Colonel Van Trees was a Whig, but later became a Republican, and was once a candidate for state treasurer. Colonel Van Trees had two sons, Charles R. and Henry E., who participated in the Civil War. His family consisted of five sons and five daughters, all of whom lived to reach middle age. Three sons and three daughters are still living (1914), namely: John, of St. Louis, Missouri; Henry E., a resident of California; William L., of Washington; Mrs. Helen S. Scudder, of Washington; Lida, living on the old home place, and Mrs. Emma B. Hyatt, the widow of Hiram Hyatt. Col. John Van Trees was married in May, 1830, to Laura G. Prentiss, who was born in Lexington, Kentucky, a daughter of Thomas Green and Laura G. (Porter) Prentiss, natives of Rutland, Vermont, who settled in Lexington, Kentucky, and built the woolen mills in that town. Subsequently, they came to the banks of the White river, in this county, and there, with certain other New England settlers, established a town, which has now vanished. Mrs. Emma B. Hyatt is a descendant of Capt. John Prentice, a Revolutionary soldier who changed the spelling of the name from Prentice to Prentiss. The paternal grandfather of Warren Van Trees was John Van Trees. His wife was Laura (Prentiss) Van Trees. The former was a native of Pennsylvania and the latter of Indiana, both of whom were pioneers in Daviess county, and where he purchased one hundred acres of land for one hundred dollars. This land had been sold for taxes amounting to nine dollars and eighty cents. Two hundred dollars an acre has lately been refused for this same land. John Van Trees owned several farms, but made his home in Washington, where he had a beautiful house and other property. He started a pork-packing business in Washington which he conducted for many years. He was also an extensive dealer in general merchandise and operated a store. John Van Trees was county clerk for twenty years. His penmanship was exceptional and almost like copper-plate. He lived to be ninety-one years old and his wife died at the age of sixty-eight. They had a large family of children as follows: Thomas P., John M., Charles R., Henry, Helen, Lydia G., Ann Elida, Laura, Emma B., William, and one who died in infancy, the first born.

Charles P. Scudder, M.D., physician and surgeon, of Washington, Indiana, was born in that city on November 8, 1859, a son of Dr. John A. and Helen (Van Trees) Scudder, natives of Daviess county, who were the parents of seven children namely: Dr. Charles P.; with whom this narrative deals; Tillie F., the wife of S.B. Boyd, of the Washington Democrat; Laura G., the wife of John L. Winston, of Washington; Anna V., the wife of R.C. Davis, of Indianapolis; Dr. David A., deceased, and two who died young. The late Dr. John A. Scudder, was reared in Daviess county, Indiana, and was a physician practicing in Washington for thirty-five or forty years. He served throughout the Civil War as an army surgeon and died in 1896, at the age of sixty-three years. His widow still survives him. Both were members of the Cumberland Presbyterian church. He was pension examiner in Washington for more than thirty-five years... The maternal grandparents of Dr. Charles P. Scudder were John and Laura (Prentiss) Van Trees, the former a native of Cincinnati, Ohio, and the latter a native of Indiana, pioneers in Daviess County. The Washington Gazette, Washington, Indiana, Second Part, page 1, Saturday, April 9, 1892: MRS. JOHN VAN TREES. ONE OF WASHINGTON'S OLDEST CITIZENS PASSES AWAY. A few minutes before twelve o'clock Saturday night the spirit of one of Washington's pioneer ladies left the body and a long and useful life was at an end. After several days of suffering Mrs. Laura G. VAN TREES, the venerable wife of Col. John VAN TREES, died surrounded by members of her family and her husband of sixty-two years. Mrs. VAN TREES' maiden name was PRENTISS, and she was born at Lexington, Kentucky, seventy-eight years ago. She was a sister to Charles M. PRENTISS, of this city, and came to Indiana with her father nearly three quarters of a century ago, locating at Hindostan. While there Mrs. VAN TREES' father became a victim of a plague that killed nearly every one in the place, and she was taken to Paoli where an aunt reared her. When a mere girl she was married to Mr. VAN TREES and moved with him to this city where they have since lived. Then children were born to them, all of whom are now living. They are Mrs. Lydia AIKMAN, Dallas, Texas; Henry VAN TREES, Oklahoma, Will VAN TREES, New Orleans; and Mrs. John A. SCUDDER, Mrs. Hiram HYATT, Mrs. William AIKMAN, Miss Lida VAN TREES, Thomas VAN TREES, Charles VAN TREES and John M. VAN TREES, of this city. Mrs. VAN TREES was a member of the Presbyterian church. The funeral will take place Wednesday morning at 9 o'clock am. Burial at Oak Grove Cemetery, Washington twp., Daviess Co., Indiana.

Miss Ann Eliza Van Trees Dies Suddenly Last Night at Her Home. Death, a ruthless, relentless death which gave no warning of its approach, yet was as certain and as deadly as the bite of the poisonous Cobra, chose Anna Eliza Van Trees, better known as "Aunt Lida" as its victim at an early hour this morning. Miss Van Trees was found dead in the bathroom of her home in the Hyatt residence in east Main street by her brother, Will Van Trees, about 1 o'clock this morning. Miss Van Trees with her brother had an apartment at the Hyatt home. Mr. Van Trees was awakened shortly after midnight by a light from his sister's room. He went back to sleep, and on awakening again and seeing the light still shining through her door, he got up to see if she might be ill. When he did not find his sister in her room, he went to the bathroom and found her body just inside the door. Death came as the greatest of shocks for Miss Van Trees had apparently been enjoying the best of health. She had been about her home yesterday and seemed sunny in disposition and without any bodily pains. A number of friends and neighbors had been in during the evening last night and she had talked with them and gave no indication that her life was to be snuffed out within the next few hours. She retired about 9:30 o'clock last night, evincing no outward appearances of any ailment. Death was believed due to a heart spasm, or acute indigestion, although no alarming sounds were heard by her brother who slept in a room near that of Miss Van Trees. Had not the light coming from her room awakened him, the fact that death had visited the home would not have been discovered until this morning. Mr. Van Trees called Will Hyatt who went to the home of Sam Boyd, a neighbor and relative and awakened him after discovering that Miss Van Trees had been taken. Miss Van Trees was one of the most lovable women of this community. Her sister, Mrs. Emma B. Hyatt, died in the same home just six weeks before. Miss Van Trees was the only surviving daughter of the lat Colonel John and Laura G. (Prentiss) Van Trees, and is next to the last of ten children. Her brother, Will Van Trees, is the sole surviving member of the immediate family. If one were to select a key note to the character of this beloved woman, who was more familiarly known by the endearing term of "Aunt Lida", it would be "service." Miss Van Trees seemed to find the greatest enjoyment in life by administering to the needs of her brothers and sisters. She cared for them through all the illnesses and frailities that are common to life. With it all " Aunt Lida" was one of the most cheerful and sunniest of women. She seemed the very essence of happiness and satisfaction in living a good and useful life. Miss Van Trees was born in the old Van Trees home which is now the community home of the War Mothers in east Main street. She lived here until it was sold some six years or seven years ago when she moved to the house just next door. She was a life long resident of Washington. Miss Van Trees was born July 29, 1844, making her nearly eighty three years of age. She never married. Miss Van Trees was a member of Westminster Presbyterian church and lived a life that was exemplary. Her passing with such suddenness struck a grievous blow to the hearts of those who had known her and had loved her for the many qualities that endeared her to all those with whom she came in contact. The community loses one of its finest women. Funeral services have been arranged for Saturday morning at 10 o'clock from the residence. The Rev. C.J. Grimes will be in charge and burial will be made in Oak Grove cemetery.

W.L. VanTrees is Victim of Heart Spasm. Last of Family of Ten Children is Removed. Death Strikes Rapidly. Death within the short span of six months removed the last four members of one of Daviess county's pioneer families. The name of VanTrees has been on every page of Daviess County's history, and about four o'clock yesterday afternoon the last member of a family of ten children passed away in the person of William L. VanTrees. It was the third time that death had visited that home within seven weeks. Mrs. Emma Hyatt died there May 20, Miss Ann Eliza VanTrees June 30, and yesterday afternoon Mr. VanTrees. With the close circle broken by Mrs. Hyatt's death, the surviving brother and sister lingered but a short time before joining her. It was said that Miss VanTrees became quiet and thoughtful following her sister's death and neither brother nor sister were their old familiar selves following the breaking of the little family circle. Henry VanTrees, a brother, died in California last February. Mr. VanTrees went suddenly although he had been ill for the past year. He walked down town only yesterday morning and was seized with a heart attack about 11 o'clock at his home. He died some five hours later. His death was caused by angina pectoris, or heart spasm. He was fully clothed at the time of his death, and was never bedfast from his illness. Mr. VanTrees for many years traveled with the Robinson and other circuses as advertiser and advance agent. He was a musician of note possessing a fine voice and playing instrumental music in the old W.H. Kiefer band. His later years were spent as a sign painter and decorator. No finer work was done in home beautification than was done by this well known artisan. Mr. VanTrees was a member of the Presbyterian church and sang in that choir for a number of years. He was a life long resident of Washington, he having been born in the old VanTrees home which is now the War Mother's community house. He moved with his sister to the Hyatt home just next door after the homestead had been sold and there his remaining years were passed. Mr. Van Trees was born October 26, 1856, making him just past seventy years of age. He was widely known and respected as a man of unusual personality and amiability. His passing has taken from the community one of its finest citizens. Mrs. VanTree's only surviving relatives are nephews and nieces. He had made his home with Will A. Hyatt since the death of his two sisters. Funeral services will be held tomorrow morning at 10 o'clock from the Hyatt home in East Main street. The Rev. C.J. Grimes will be in charge. Burial will be made in Oak Grove cemetery.

Thomas P. Van Trees, the father of Warren (Van Trees), was reared in Washington (Daviess County, Indiana), where his father was a pork packer. Thomas P. was employed by his father (Col. John Van Trees) to take pork and poultry down the White river and the Ohio and Mississippi rivers to New Orleans. During the War he was a prospector in the mountains of Colorado and Mexico. He also ran a hotel in Denver when it was a small village. He finally returned to Washington and engaged in the milling business for a number of years after which time he moved to his father's farm in Washington township, just north of town, and died there in 1911, at the age of eighty-one years. His wife survived him and now is eighty-one years old. Mrs. Thomas P. Van Trees is a devoted member of the Presbyterian church as was also her deceased husband.

W.L. VanTrees is Victim of Heart Spasm. Last of Family of Ten Children is Removed. Death Strikes Rapidly. Death within the short span of six months removed the last four members of one of Daviess county's pioneer families. The name of VanTrees has been on every page of Daviess County's history, and about four o'clock yesterday afternoon the last member of a family of ten children passed away in the person of William L. VanTrees. It was the third time that death had visited that home within seven weeks. Mrs. Emma Hyatt died there May 20, Miss Ann Eliza VanTrees June 30, and yesterday afternoon Mr. VanTrees. With the close circle broken by Mrs. Hyatt's death, the surviving brother and sister lingered but a short time before joining her. It was said that Miss VanTrees became quiet and thoughtful following her sister's death and neither brother nor sister were their old familiar selves following the breaking of the little family circle. Henry VanTrees, a brother, died in California last February...

Colonel Van Trees had two sons, Charles R. and Henry E., who participated in the Civil War. His family consisted of five sons and five daughters, all of whom lived to reach middle age. Three sons and three daughters are still living (1914), namely: John, of St. Louis, Missouri; Henry E., a resident of California; William L., of Washington; Mrs. Helen S. Scudde, of Washington; Lida, living on the old home place, and Mrs. Emma B. Hyatt, the widow of Hiram Hyatt.

Sedgwick County, in the southern part of the Kansas, is 135 miles west of the Missouri line, 250 miles east of Colorado and is the second county north of Oklahoma. The territory of which it is comprised was included in Butler county until 1867, when Sedgwick was formed by act of the legislature... The county was named in honor of John Sedgwick, a general of the Civil war, who was killed at Spottsylvania Court House, Va., in May, 1864. The first settlers were William Greiffenstein, who located on Cowskin creek and established a trading post in 1865... There were a number of Indian scares in Sedgwick county, and although no fighting took place here, a detachment of the Fifth United States infantry, under command of Col. Barr, was stationed on the site of Wichita in 1867. A number of the men, at the expiration of their term of enlistment, became settlers in the vicinity. An attempt to effect county organization was made in the fall of 1869, when an election was held which was declared void by the governor on account of irregularities. A new census was taken and in the winter of 1870 the governor issued a proclamation organizing the county, designating Wichita as the county seat, and appointing S. C. Johnson, William Lockard and Henry Stein commissioners... During the last Indian scare, which occurred in 1874, more than 1,000 people from Sedgwick, Kingman, Sumner and Harvey counties came to Wichita in a single day. In a few days they all returned to their homes.

Wichita, the second largest city in Kansas, is the judicial seat of Sedgwick county, in the southern part of the state. It is located 230 miles from Kansas City on the Arkansas river, and is one of the most mportant railway centers in Kansas, having direct connections with almost every city west of the Mississippi... The history of the city begins with the establishment of a trading post at that point in 1863 by J. R. Mead. The Wichita Indians were then occupying the land and the town was named for that tribe. The word means "Scattered Lodges," and for a long time the little town lived up to its appellation. As early as 1860 William Mathewson, the original Buffalo Bill, freighted through Wichita, and in 1869 settled on a claim near the town site. On July 9, 1868, a military postoffice was established with Col. Barr, who was in command of the militia stationed there, as postmaster. Shortly afterward a civil postoffice was established with Milo B. Kellogg, manager of Durfee's ranch, as postmaster. About the same time the Wichita town company was organized by Gov. S. J. Crawford, W. W. H. Lawrence, J. R. Mead, E. P. Bancroft, A. F. Horner and I. S. Munger. A survey of the site was made by Mr. Finn. William Greiffenstein bought Moore's place, now comprising a part of the city, and for a long time there was a rivalry between the two sites. In 1870 Mr. Munger opened a hotel and the Wichita Vidette was started by F. A. Sowers. Before the railroad was completed there was bitter rivalry between Wichita and Park City, which stood 14 miles to the northwest on the Arkansas. An attempt was made to divert the cattle trade to the Park City route, and for a long time it seemed that this might be successful. However, Wichita succeeded in securing the county seat and in May, 1872, the railroad reached this point and settled the rivalry. By that time quite a city had grown up, handling the vast cattle trade of the southwest and having all the undesirable conditions connected with a rapidly growing frontier town. In 1871 Wichita was incorporated as a city of the third class. At the election 156 votes were polled and the following officers were elected: Mayor, E. B. Allen; attorney, D. C. Hackett; police judge, H. E. Vantrees; clerk, O. W.
Brownwell; treasurer, N. A. English; marshal, M. Meagher; councilmen, W. B. Hutchinson, S. C. Johnson, C. Schattner, George Schlichter, A. H. Fabrique and George Vantillburg. The next year, having sufficient population, the form of government was changed to that of a city of the second class. In March, 1872, the United States land office was moved here from Augusta, Butler county. The first school was held in an army dugout in the winter of 1869-70. A $5,000 school house was built in 1871. The Wichita Eagle and the Wichita Beacon were both founded in 1872, and have since been among the leading newspapers of the state. The first financial institution was the Arkansas Valley bank, started in 1870 by W. C. Woodman. Although the cattle driving business closed in 1875 the growth of Wichita kept on as rapidly as before. In 1880 a board of trade was organized with $20,000 capital, the waterworks were installed in 1882 and the street railway the next year. Improvements of all kinds went on very rapidly, new additions were laid out, lots were sold and houses built miles from the business section of the city. In 1888, on the occasion of the auction sale of the lots in a new addition, the Wichita Eagle wrote an editorial calling a halt on speculation and telling the people that the time had come to quit buying and selling at inflated values. With that the boom was over, the lots were turned back to cow pastures and cornfields and the city paid for the boom with fifteen years of comparative depression.
History of Sun City, Barber County, Kansas - Sun City was plotted in 1872 and settled in 1873. In 1871 young George Walker, his brother, and an Army Officer established a trading post in a dugout on the east bank of Turkey Creek in what is now known as the Shutts pasture. In the winter of 1871-1872 a Col. Griffin, himself a buffalo hunter, became the first settler at the same location. According to the Barber County Index, he was the first settler in Barber County. He was killed and scalped by the Indians the following summer. Among the earliest settlers were the Rev. and Mrs. J.M. Adams and sons, Green and William. They arrived from Kentucky April 3rd, 1873. Others were Minerva Adams, C.H. Douglas, Mrs. Molly Saunders, Mr. and Mrs. John Bullock, Sam Helton, Mr. and Mrs. C.W. Owens, Mr. and Mrs. Milton Clements, Estelle Whitaker, George Walker, Jim Carl, Thomas and Henry Walker, Mr. and Mrs. Tom Whitaker, Mr. and Mrs. John Montgomery, Frank Whitaker, Mr. and Mrs. S. Flemings, Bob Adams, Edd Coon, Charlie Walker, Major Bowlus, Mr. and Mrs. VanderPool, Frank Saunders, HENRY VAN TREES, and Mr. and Mrs. Lee Adams. A stockade was built in 1874 where the Santa Fe depot now stands. The first school house was built in 1875, and set south of the present Baptist Church, about where the alley is. In 1874, due to Indian raids on the settlers, the militia was organized, a company of 60 men. A buffalo hunters' camp, of which M.H. Clements was a member, was used as a basis for the establishment of a stockade. It was located on the block where the Bissantz Store and the Depot are located. There was a block house in the center surrounded by rifle pits and picket fences. There was another stockade on the Wm. Ward farm on the west side of the end of Main Street. It was a sod stockade 8 feet high and 8 feet wide, enclosing about 5 acres. Each night the settlers brought their families to the stockade. In the morning the men would accompany the soldiers to scout the neighborhood to see if it was safe to go work on their claims. If no Indians were sighted, they would take their families and go to work - returning again at night to the stockade. As many as 40 people were killed by the Indians, south of Sun City to the state line south. In 1885 the business places of Sun City were two hotels, three livery barns, two dry goods stores, three groceries, a bank, a hardware store, and a shoe shop. M.H. Clements came to Sun City with a party of buffalo hunters in 1872. In January, 1875, while freighting supplies from Hutchinson in company with 6 other men they were overtaken by a blizzard, and two of the men were frozen to death. Mr. Clements and Reuben Marshall each had their legs so badly frozen they had to be amputated. Improvements are being made through the city now that would open the eyes of the county seats of the other counties. Our county officials are all here with their families ... The probate judge and his clerk have been busy since the first day issuing certificates on lots. They hope to have all the lots filed on by the 1st of May so they can enter the land and commence issuing deeds as soon as possible. The judge expects to have all the lots deeded within sixty days. The sheriff has nothing to do. He says the city is too orderly for him to make a living. There has not been a single street quarrel. Everybody is happy. Steps have been taken toward the establishment of a U. S. land office here, owing to the central location and the distance from the offices at Kingfisher and Oklahoma City. This is a matter that should be attended to and pushed forward by every claim holder in this new country, as well as townsite settlers, and Arapahoe is the place to fight for. County G is by far the best county and Arapahoe the finest townsite. Homestead settlers are on their claims and many of them are making garden and putting in crops. Nearly all kinds of business are represented here, but we need more to supply the trade that will soon come here...

The material allegations in the petition are as follows: "That the defendant H. E. Van Trees was the duly elected, qualified, and acting county treasurer of said county during the period herein named; that by virtue of his said office, and while acting as county treasurer of said county, the defendant H. E. Van
Trees, collected and received as such officer the sum of $ 6,914.93, all of which was the money and property of said county and Territory, and was received from the payment of taxes for the years 1892, 1893, and 1894, and while the defendant was the county treasurer as aforesaid, and while acting as such official, he disbursed of said moneys collected as aforesaid the sum of $4,693.99, and no more; that the said H. E. Van Trees has not at any time disbursed or accounted for, or paid over to his successors in office, the remaining sum of money so received by him, to-wit:, the sum of $ 1,112.58. The
plaintiff shows that the reason the said $ 1,112.58 cannot be distributed to the following funds to which it belongs, and the amount credited to each which is due it, to-wit, territorial fund and county fund, as follows: Salary fund, court fund, poor fund, insane fund, road and bridge fund, and supply fund, contingent fund, county sinking fund, county school fund, separate school fund, township fund, district school sinking fund, school township fund--is that on the 9th day of December, 1896, the county court house building, together with all the books, papers, records of the said county of Custer, formerly G county, were destroyed by fire, including all the records, books, papers, and accounts of every
description belonging to the county treasurer's office; and the plaintiff states that he is unable to give any more accurate and better description of the $1,112.58, or the fund to which it belongs, than herein given, for the reason hereinbefore given. The plaintiff states that there is now due from him, the
said H. E. Van Trees, of the moneys so received, and not disbursed or not accounted for, or not paid or delivered to his successor in office or any other proper person, the sum $ 1,112.58; that due demand has been made for the payment of the said sum of money of each of the defendants." ... "Third. For a third and other defense to said alleged cause of action the defendants allege that in the spring and summer of 1894, while the defendant Van Trees was acting as such county treasurer of said G county, his office was located in the town of Arapahoe, in said county, the then county seat of said county; that said town was at said time without a bank or depository for the safe deposit and keeping of funds belonging to said county and other municipalities for whom said county treasurer was required by law to collect taxes and public moneys; that the board of county commissioners of said county made no provision, though often requested so to do by said county treasurer, for the safe deposit or keeping of said money safe from loss by fire, robbery, or other manner, but directed said county treasurer to deposit said funds in such bank as he desired for safe-keeping; that under the advice and by the consent of such board of county commissioners the said H. E. Van Trees, as such county treasurer, did deposit all public moneys coming into his hands as such officer in the Farmers' & Mechanics' Bank in the town of Watonga, in the county of Blaine, which said bank was a duly organized corporation, and carrying on a regular banking establishment, and the said county treasurer had reason to believe and did believe that such bank was a solvent and wholly reliable establishment, and under such belief he deposited such funds in said bank as county treasurer, and not otherwise; that said bank was selected as a depository for said funds as the nearest and most convenient place or bank for depositing said funds with safety; that while some of the funds of several of the municipalities in the hands of said county treasurer collected as such officer were in said bank, deposited by him as such county treasurer, the said bank failed and became insolvent, and thereafter neither said bank nor the receiver appointed by the court to take charge of its insolvent estate was ever able to, and never did, repay or turn over to the said county treasurer any part or portion of said money so deposited with said bank by said treasurer. And defendants aver that, notwithstanding the loss of such money by the failure of the bank, the said H. E. Van Trees has long since paid over to the county of Custer all the money in his hands as such treasurer due the county of Custer, and has not withheld or failed to pay any such money whatsoever coming into his hands as such county treasurer."

Charles P. Scudder, M.D., physician and surgeon, of Washington, Indiana, was born in that city on November 8, 1859, a son of Dr. John A. and Helen (Van Trees) Scudder, natives of Daviess county, who were the parents of seven children namely: Dr. Charles P.; with whom this narrative deals; Tillie F., the wife of S.B. Boyd, of the Washington Democrat; Laura G., the wife of John L. Winston, of Washington; Anna V., the wife of R.C. Davis, of Indianapolis; Dr. David A., deceased, and two who died young. The late Dr. John A. Scudder, was reared in Daviess county, Indiana, and was a physician practicing in Washington for thirty-five or forty years. He served throughout the Civil War as an army surgeon and died in 1896, at the age of sixty-three years. His widow still survives him. Both were members of the Cumberland Presbyterian church. He was pension examiner in Washington for more than thirty-five years... The maternal grandparents of Dr. Charles P. Scudder were John and Laura (Prentiss) Van Trees, the former a native of Cincinnati, Ohio, and the latter a native of Indiana, pioneers in Daviess County. For many years John Van Trees was a merchant in Washington, Indiana, and was county clerk for more than thirty years. Both died in Washington...

Charles P. Scudder, M.D., physician and surgeon, of Washington, Indiana, was born in that city on November 8, 1859, a son of Dr. John A. and Helen (Van Trees) Scudder, natives of Daviess county, who were the parents of seven children namely: Dr. Charles P.; with whom this narrative deals; Tillie F., the wife of S.B. Boyd, of the Washington Democrat; Laura G., the wife of John L. Winston, of Washington; Anna V., the wife of R.C. Davis, of Indianapolis; Dr. David A., deceased, and two who died young. The late Dr. John A. Scudder, was reared in Daviess county, Indiana, and was a physician practicing in Washington for thirty-five or forty years. He served throughout the Civil War as an army surgeon and died in 1896, at the age of sixty-three years. His widow still survives him. Both were members of the Cumberland Presbyterian church. He was pension examiner in Washington for more than thirty-five years... The maternal grandparents of Dr. Charles P. Scudder were John and Laura (Prentiss) Van Trees, the former a native of Cincinnati, Ohio, and the latter a native of Indiana, pioneers in Daviess County. For many years John Van Trees was a merchant in Washington, Indiana, and was county clerk for more than thirty years. Both died in Washington...

William Barton Aikman is the son of Barton Stone Aikman and was born about 1834. William Barton Aikman married Elnora Richardson in 1855 in Vermillion County, Indiana.

Life Long Resident of City Is Victim of Hardening of the Arteries. Mrs. Emily (!) B. Hyatt, a descendant of one of Washington's pioneer families and a lifelong resident of the community, passed away at her home, 608 East Main Street, this morning about 3:30 o'clock. Mrs. Hyatt had been precariously ill for a number of days and bedside reports were given hourly as to her condition. Death was due to the hardening of the arteries. Mrs. Hyatt was born in the old Van Trees homestead, which is now the War Mother's community home, and died in the house just next door to her birthplace. She was the daughter of the late Colonel John M. and Laura Van Trees. She was one of three surviving members of a family of twelve. Mrs. Hyatt was entering her seventy sixth year, she having been born in 1851. She had been in declining health for the last four years that forced her to gradually drop from the place in the social and religious life of the community which she held. Mrs. Hyatt was married to Hiram Hyatt, who preceded her in death many years ago. They are survived by two sons, Will A. Hyatt, who made his home with his mother, and Harry V. Hyatt, of Frankfort. Mrs. Hyatt was a woman of strong personality who made a deep impression on the life of this community. She was widely known through the state, she being one of the pioneer members and organizers of the Women's Federated club in Indiana. Mrs. Hyatt was prominent in the social life of Washington until ill health forced her to withdraw from many organizations in which she was a member. Mrs. Hyatt was a member of the White River chapter Daughters of the American Revolution in which organization she had a deep seated interest. Mrs. Hyatt was a life long member of the Presbyterian church. She contributed in money and time to church work and was as constant in attendance to its services as her health would permit. In addition to her two sons, Mrs. Hyatt is survivewd by an only grand daugher, Sarah Emily Hyatt, who is well known here and other places for her literary ability as a youthful poet. One sister, Mrs.(!) Lida Van Trees and one brother, Will Van Trees, are also living. Mrs. Hyatt was held in high esteem by citizens of Washington, and her passing, while not unexpected, was none the less a shock. Mrs. Hyatt had many strong traits of character that marked her as a woman of indomitable will which was at the same timeflavored with a softness that was wholly womanly in quality. In the passing of Mrs. Hyatt, no greater tribute could be paid than to say that she impressed her personality indelibly into life about her. She had many sides to her character that many never knew.Her graces were many and close friends could not help but admire the sterling worth of her life. Harry V. Hyatt, her son, and his family, are expected to arrive today. No definite anouncement of funeral arrangements have been made, and the services may not be observed before Monday, it was understood.

Unusual Rites for Mrs. Hyatt. Unusual rites will mark the passing of Mrs. Emma B. Hyatt whose funeral services will be held tomorrow. A memorial service for friends of the well known woman will be held Sunday morning at 10 o'clock from the Westminster Presbyterian church. Neither the body of Mrs. Hyatt nor relatives will be present at these rites, but will remain at the family residence in east Main street. The services will be in charge of the Rev. C.J. Grimes, pastor, who will deliver the memorial sermon. A musical solo by Mrs. Mildred Brown Sebring will also be a part of this service. Burial will take place at sunset. A short religious service and prayer will be held at the Hyatt home about 5 o'clock Sunday afternoon for relatives and close friends. Following this the body will be taken to Oak Grove cemetery where the coffin will be lowered with the last rays of the setting sun. Pall bearers for Mrs. Hyatt will be Will Bacon, O. Tombaugh, W.W. McCarty, Grant, Keith, Frank McGehee, and Ferd Gross.

Hiram Hyatt was born on June 6, 1847, and died on February 16, 1896. He was a son of Elisha Hyatt, Sr., a large landowner of Daviess county. Hiram Hyatt was educated in the common schools of Daviess county, and when a young man entered a bank in Washington. Later he became a grain merchant, and looked after his father's estate. He was city treasurer of Washington for a number of years and prominent in the councils of the Republican party in Daviess county. He was a prominent member of the Masonic fraternity and was a Knight Templar, being past eminent commander at the time of his death. At the age of eighteen he became a deacon in the Presbyterian church and served throughout his life in that capacity. He was also a great Sunday school worker and every Sunday was to be found in his accustomed place in the Sunday school. The late Hiram Hyatt was married on February 11, 1873, to Emma B. Van Trees, the daughter of Colonel Van Tress, and to this happy union two children were born: William A., a well-known real estate dealer of Washington, Indiana, and Harry V., a manufacturer of Chicago, Illinois...

Mr. (Warren) Van Trees was born on February 11, 1868, at Washington, and is the son of Thomas P. and Sarah Deane (Albertson) Van Trees, natives of Washington, and Salem, Indiana, respectively... Warren Van Trees, the subject of this sketch, lived in Washington until seven years old and then grew to manhood on his father's farm where he lived until twenty-seven. He attended the district school and the Washington public and high schools, and after leaving the farm he came to Washington and clerked for his uncle, John A. Scudder, in the drug store of Scudder & Company, for several years. He then purchased the store himself. He sold this store, finally, and was out of the business for seven yerars. Subsequently, he bought it back again and has continued in the drug business since that time. Mr. Van Trees was married on December 14, 1910, to Mrs. Martha Glenn Morris, a widow of Robert Morris, and the daughter of John A. and Indiana (Mitchell) Chandler. Two children have been born to this union, Sarah Deane and Warren, Jr...
Daviess County Indiana History, by L. Rex Myers. 1988. p324. VanTrees. Emanuel VanTrees was born in Pennsylvania 1768. His father was a native of Heidelburg, Germany. Emanuel married Juliana Starms 1790 and moved to the Washington, Ind. area, via the Ohio River with the Robert Bennefield and John VanCleve families. They settled in the French location #304 east of Vincennes. This location was listed on the original plat, dated 1813, as Liverpool. The name was changed to Washington in 1816 when Indiana became a state. This plat was recently given to the Daviess County Historical Society. Samuel Wilkins and Emanuel VanTrees donated land where Washington, In. now stands, thus the VanTrees Street which was named after him. John Merriam Van Trees, the son of Emanuel, was appointed colonel in the 24th Regiment Indiana Militia. Colonel John VanTrees married Laura G. Prentiss, May 27, 1830. They had eleven children. John built the VanTrees home at 600 E. Main St., Washington Ind. In this city block were several homes built by persons related to the VanTrees family. Names such as Winston, Boyd, Scudder, and Hyatt. Warren VanTrees built on the northeast corner of 6th and VanTrees Streets. It has been told and handed down through the family that Abraham Lincoln, then an unknown travelling attorney, stopped in Washington and called on Colonel John VanTrees for information regarding the area. Nothing has appeared in writing regarding this, so no way to say if such is true. Direct descendents of Emanuel VanTrees known to be living are Warren VanTrees, Jr., his son, James Barrett, and his three sons, Craig, Neil, and John; and Warren's daughter, Susan VanTrees, all now living in Rushville, Ind. Colonel John had a son, Thomas. Thomas had a son, Warren. Warren operated a drug store several years in Washington, known as the VanTrees Drug Store. He was at one time City Clerk of Washington, Ind. --- Submitted by Warren Van Trees. 1987.

Charles P. Scudder, M.D., physician and surgeon, of Washington, Indiana, was born in that city on November 8, 1859, a son of Dr. John A. and Helen (Van Trees) Scudder, natives of Daviess county, who were the parents of seven children namely: Dr. Charles P.; with whom this narrative deals; Tillie F., the wife of S.B. Boyd, of the Washington Democrat; Laura G., the wife of John L. Winston, of Washington; Anna V., the wife of R.C. Davis, of Indianapolis; Dr. David A., deceased, and two who died young. The late Dr. John A. Scudder, was reared in Daviess county, Indiana, and was a physician practicing in Washington for thirty-five or forty years. He served throughout the Civil War as an army surgeon and died in 1896, at the age of sixty-three years. His widow still survives him. Both were members of the Cumberland Presbyterian church. He was pension examiner in Washington for more than thirty-five years... The maternal grandparents of Dr. Charles P. Scudder were John and Laura (Prentiss) Van Trees, the former a native of Cincinnati, Ohio, and the latter a native of Indiana, pioneers in Daviess County. For many years John Van Trees was a merchant in Washington, Indiana, and was county clerk for more than thirty years. Both died in Washington... On August 20, 1895, Doctor Scudder was married to Louise J. Stamper, a daughter of William W. and Bertie (Davis) Stamper, and to this union four children have been born, Charles P., John A., William W. and David Fenwick, the latter of whom died at the age of two and one half years. Mrs. Scudder was born in Owen County, Kentucky. Her parents who were likewise natives of that county, are now living in Louisville, Kentucky. They are the parents of four children, Louise J., who married Doctor Scudder; Mrs. Ruth Swope; Mrs. A.W. Ellen, and John, the latter of whom died when a child...

Samuel Brown Boyd, editor of the Daily and Weekly Democrat, at Washington, this county, was born in Yorkville, Dearborn county, Indiana, March 14, 1858, being a son of John and Elizabeth (Miller) Boyd, who were natives of Ireland and Ohio, respectively. The family numbered nine children, three of whom are living, Mrs. John S. Goshorn, Mrs. Millie B. Johnson and Mr. Boyd, all of Daviess county, Indiana. The parents are dead. Mr. Boyd moved from Dearborn county to Daviess county with his parents in 1871. Both parents died shortly after the removal, the father in 1871 and the mother in 1875. At the age of seventeen Mr. Boyd found himself entirely upon his own resources. He worked on a farm in the summer and went to the country schools in the winter until he secceeded in securing a license to teach. He continued at school work for ten years, teaching in country schools for four years; principal of the Odon school for one year, in the grammar school, Washington, one year and county superintendent of schools four years - 1883-1887. In the meantime, he attended school two summers at Danville, Indiana. In 1885 he bought a third interest in the Democrat; in 1887 this was increased to one-half interest, and in connection with Stephen Belding and B.F. Strasser, respectively, he published the Daily and Weekly Democrat until 1891, when he purchased the entire plant. In 1906 he sold a half interest in the plant to Henry Backes and the publication has been issued since then under the firm name of Boyd & Backes. Mr. Boyd was married on December 29, 1887, to Miss Tillie Scudder, eldest daughter of the late Dr. John A. Scudder, of Washington. To this union five children were born, two of whom are dead and three are living -- Samuel Jr, John Scudder and Polly Ruth, aged, respectively, twenty-two, nineteen and seventeen. Mr. Boyd is a prominent member of the Democratic Editorial Association of Indiana, in which he served as president in 1895 and was secretary for several years. He has been an Odd Fellow since 1882 and is an ardent member of the Episcopal church. He served as a trustee of the Southern Indiana hospital for the insane during Governor Matthew's administration -- 1893-1897; also on the city school board of Washington.

Life Long Resident of City Is Victim of Hardening of the Arteries. Mrs. Emily (!) B. Hyatt, a descendant of one of Washington's pioneer families and a lifelong resident of the community, passed away at her home, 608 East Main Street, this morning about 3:30 o'clock. Mrs. Hyatt had been precariously ill for a number of days and bedside reports were given hourly as to her condition. Death was due to the hardening of the arteries. Mrs. Hyatt was born in the old Van Trees homestead, which is now the War Mother's community home, and died in the house just next door to her birthplace. She was the daughter of the late Colonel John M. and Laura Van Trees. She was one of three surviving members of a family of twelve. Mrs. Hyatt was entering her seventy sixth year, she having been born in 1851. She had been in declining health for the last four years that forced her to gradually drop from the place in the social and religious life of the community which she held. Mrs. Hyatt was married to Hiram Hyatt, who preceded her in death many years ago. They are survived by two sons, Will A. Hyatt, who made his home with his mother, and Harry V. Hyatt, of Frankfort... In addition to her two sons, Mrs. Hyatt is survived by an only grand daugher, Sarah Emily Hyatt, who is well known here and other places for her literary ability as a youthful poet. One sister, Mrs.(!) Lida Van Trees and one brother, Will Van Trees, are also living...

Notes for JAMES BARRETT VAN TREES:
Daviess County Indiana History, by L. Rex Myers. 1988. p324. VanTrees. Emanuel VanTrees was born in Pennsylvania 1768. His father was a native of Heidelburg, Germany. Emanuel married Juliana Starms 1790 and moved to the Washington, Ind. area, via the Ohio River with the Robert Bennefield and John VanCleve families. They settled in the French location #304 east of Vincennes. This location was listed on the original plat, dated 1813, as Liverpool. The name was changed to Washington in 1816 when Indiana became a state. This plat was recently given to the Daviess County Historical Society. Samuel Wilkins and Emanuel VanTrees donated land where Washington, In. now stands, thus the VanTrees Street which was named after him. John Merriam Van Trees, the son of Emanuel, was appointed colonel in the 24th Regiment Indiana Militia. Colonel John VanTrees married Laura G. Prentiss, May 27, 1830. They had eleven children. John built the VanTrees home at 600 E. Main St., Washington Ind. In this city block were several homes built by persons related to the VanTrees family. Names such as Winston, Boyd, Scudder, and Hyatt. Warren VanTrees built on the northeast corner of 6th and VanTrees Streets. It has been told and handed down through the family that Abraham Lincoln, then an unknown travelling attorney, stopped in Washington and called on Colonel John VanTrees for information regarding the area. Nothing has appeared in writing regarding this, so no way to say if such is true. Direct descendents of Emanuel VanTrees known to be living are Warren VanTrees, Jr., his son, James Barrett, and his three sons, Craig, Neil, and John; and warren's daughter, Susan VanTrees, all now living in Rushville, Ind. Colonel John had a son, Thomas. Thomas had a son, Warren. Warren operated a drug store several years in Washington, known as the VanTrees Drug Store. He was at one time City Clerk of Washington, Ind. --- Submitted by Warren Van Trees. 1987.
