CONTRACT
Sales Contract
From this point on in this contract, Kelly Smith is referred to as the Seller,
and ______ of _________ is referred to as the Buyer. Horse(s) in question are
_______________
Section I - Showing
A - Mares/Broodmares
Broodmares are able to show in halter classes and at their trained discipline
if they are reconditioned to do so. Mares sold as show horses are NOT permitted
to be turned into broodmares. They may be bred at buyer's discretions, but they
must maintain their showing.
B - Levels
Horses MUST be shown in levels as stated at the time of the sale. Any horse
found to be showing at a higher level than stated at the time of sale seller
will find the buyer guilty of breaking this contract and the horse will be
removed from buyer's home without a refund. Unless the seller has stated that
the horse may be moved up to x level/year.
C - Disciplines
Horses MUST be shown in discipline(s) stated at the time of the sale. Horses
may not show in any other discipline outside what is stated, unless the buyer
chooses to show the horse(s) in the lowest level of a new discipline after
undergoing training.
Section II - Horse Care/Information
A - Horse Care
Horses must visit the vet and farrier as stated in
the Horses Forever rules. The seller guarantees the horse to be in excellent
health at the time of sale. It is expected of the buyer to purchase for the
horse(s) any supplements and any other item required for the horse(s) to
maintain good health, which will be stated at the time of the sale.
B - Information
The buyer may not change any information about the horse after the sale. This
includes any barn initials, pedigree information, color, markings, age, height,
etc. except for the following reasons:
Age may be advanced once a year in agreement to Horses Forever rules. This may
be done on the horse(s) Date of Birth, or on the first of January.
Age may be advanced if Sire or Dam’s age has been speed
aged. Seller will notify Buyer if this occurs.
Height may be changed on horses still growing, but must be around the expected
height given on those horse(s) at the time of sale.
C – Website
The Buyer is required to furnish a single page or
multiple pages devoted to the horse(s) sold to the buyer. These must be
e-mailed to the Seller within 30 days or 1 month from the date the contract was
signed. Included on this page must be the full information, photos of the
purchased horse(s), and recognition to Mare Haven Farm as the previous owner/breeder.Direct linking to the Seller's pages is forbidden
& will void the contract. If the Buyer fails to furnish a page to the
Seller within the allotted time the Buyer will receive a request for such page
from the Seller. If after 60 days or 2 months the Buyer has failed to furnish a
page for the purchased horse(s) the Buyer will be breaking this contract and
the Seller will remove all horses sold to the Buyer.
Section III - Buying/Selling
A - Buybacks
The Seller has mandatory buyback rights to the horse(s) sold to the buyer. The
buyer must get in contact with the seller PRIOR to putting a horse up for sale.
It is suggested the buyer keep a record of each horse the buyer has purchased
from the seller along with an email address. This remains in effect for as long
as the seller remains in the game, including any time the seller may be on a
leave, regardless of how long the leave may last as the seller has not quit the
game.
The Buyer must notify the Seller they intend to sell the horse(s) and offer the
Seller a chance to buy back the horse. If the Seller wishes to buy the horse
back, the Buyer must sell the horse back for an amount to be determined at that
time, that is equal to or less than the Buyer’s intended sales price. If the
Seller does not wish to buy back the horse(s), contract is then void and the
Buyer may sell the horse to whomever they wish. If the Seller does not reply to
a buyback email within a week, unless on a leave without email access, the
contract is void and the Buyer may sell.
Horses found being sold without offering the Seller buyback rights will be
confiscated, and the Buyer will have to compensate the prospective purchaser.
B - Disappearing Horses
Horse(s) sold by the Seller may not disappear from this game. The Buyer is
expected to show, breed and keep the horse in the game. Horses found to have
disappeared will be returned to the Seller. If the Buyer decides to quit and
the Seller is still within the game, the buyer must GIVE back the horse(s)
purchased for free as money will mean nothing to the Buyer at that time. If the
Seller is not in the game, the Buyer must find homes for the horse(s) purchased
from the Seller.
If the Buyer does not understand any part of this contract, please contact the
Seller. By "signing" this contract, you have agreed to all terms
stated above, and the Seller will have the right to use whatever means
necessary to take back any horse(s) where the contract is broken. It is
recommended you keep a copy of this contract somewhere for future reference,
but if you misplace it or would like to request a copy, email the Seller at
MareHavenFarm@aol.com.
